Terms of Service

1. Acceptance of Terms

These Terms of Service (“Terms”) constitute a legal agreement between you and TagMath (“Company,” “we,” “us,” or “our”). By accessing or using TagMath (“the Service”), you agree to be bound by these Terms and our Privacy Policy. If you do not agree, do not use the Service.

2. Description of Service

TagMath provides draw odds calculations, hunting strategy tools, and historical data analysis for Western big game hunting applications. The Service is for informational purposes only and does not constitute professional advice. TagMath uses statistical modeling based on historical public data to generate probabilistic estimates — these are not guarantees or predictions of future outcomes.

TagMath is not affiliated with Colorado Parks & Wildlife (CPW) or any state wildlife agency. All data is sourced from publicly available official publications and cited accordingly.

3. Eligibility and Age Requirements

You must be at least 18 years of age to create an account or purchase a subscription. If you are between 13 and 17 years of age, you may use the Service only with the involvement and consent of a parent or legal guardian who agrees to these Terms. The Service is not directed to children under 13, and we do not knowingly collect personal information from children under 13. If we learn we have collected information from a child under 13, we will delete that information promptly.

4. Account Registration and Security

You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You may not share your account with others. One subscription = one user. You agree to notify us immediately of any unauthorized use of your account.

5. Subscription Tiers and Pricing

TagMath offers the following tiers:

  • Free: Basic access to draw odds and limited features at no cost. No account required for basic browsing.
  • Season Pass ($9.99 one-time): Enhanced features for a single application season. This is a one-time, non-recurring purchase.
  • Pro Annual ($39/year): Full access to all features, including historical analysis and strategy tools. Subscriptions auto-renew annually unless canceled. We will send a reminder email before renewal.

All prices are listed in U.S. dollars and are subject to change. We will notify existing subscribers of price changes at least 30 days before they take effect. Payments are processed securely through Stripe.

6. Refunds and Cancellation

Pro Annual: We offer a 30-day money-back guarantee from the date of your initial Pro Annual purchase. To request a refund, email admin@tagmath.com within 30 days. Refunds are processed to your original payment method within 5–10 business days. After 30 days, no refunds are available for the current billing period. Cancellation takes effect at the end of your current billing cycle.

Season Pass: The Season Pass is a one-time purchase. We offer a 7-day refund window from the date of purchase. After 7 days, Season Pass purchases are non-refundable.

Upon refund, your access to paid features will be revoked immediately.

7. Important Notice Regarding Hunting Applications

TagMath provides statistical estimates based on historical public data. These estimates are NOT guarantees, predictions, or official draw odds.

YOU ACKNOWLEDGE AND AGREE THAT:

  • Preference points and bonus points represent a significant personal investment that cannot be recovered once used;
  • Application fees paid to state wildlife agencies are non-refundable regardless of draw outcome;
  • State agencies may change draw rules, quotas, unit boundaries, and point structures at any time, and TagMath may not reflect such changes immediately;
  • TagMath's analysis is based on historical patterns that may not predict future outcomes;
  • You are solely responsible for verifying all information with the applicable state wildlife agency before submitting any application.

TAGMATH STRONGLY RECOMMENDS THAT YOU CONSULT OFFICIAL STATE WILDLIFE AGENCY PUBLICATIONS AND REGULATIONS BEFORE MAKING ANY APPLICATION DECISIONS.

8. No Guarantee of Accuracy

While we strive for accuracy, draw odds are probabilistic estimates based on historical data published by state wildlife agencies. TagMath does not guarantee the accuracy of any calculation, projection, or recommendation. State agencies may change quotas, rules, point structures, and regulations at any time without notice.

9. Intellectual Property

TagMath's calculations, methodology, user interface, brand, and all related intellectual property are proprietary and protected by applicable laws. You may not reproduce, distribute, modify, or create derivative works from the Service without our express written consent. The underlying data sourced from public government publications remains in the public domain.

10. Acceptable Use

You agree not to:

  • Scrape, crawl, or use automated means to access the Service or extract data;
  • Reverse engineer, decompile, or disassemble any part of the Service;
  • Resell, redistribute, or commercially exploit TagMath's data or output;
  • Use the Service to build a competing product or service;
  • Interfere with or disrupt the Service or its infrastructure;
  • Use the Service for any unlawful purpose or in violation of any applicable law.

11. Account Termination

We reserve the right to suspend or terminate your account at any time for violation of these Terms, fraudulent activity, or any other reason at our sole discretion. If we terminate your account without cause, we will provide a pro-rata refund for any unused portion of your current subscription period.

You may delete your account at any time by emailing admin@tagmath.com. Account deletion is permanent and will result in the loss of all account data. No refund is provided for voluntary account deletion outside the applicable refund window.

12. Disclaimer of Warranties

THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE. WE MAY MODIFY, SUSPEND, OR DISCONTINUE THE SERVICE AT ANY TIME WITHOUT NOTICE.

13. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL TAGMATH, ITS OFFICERS, DIRECTORS, EMPLOYEES, OR AGENTS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING WITHOUT LIMITATION LOSS OF PROFITS, DATA, PREFERENCE POINTS, HUNTING OPPORTUNITIES, APPLICATION FEES, OR GOODWILL, ARISING FROM OR RELATED TO YOUR USE OF THE SERVICE.

OUR TOTAL AGGREGATE LIABILITY FOR ALL CLAIMS ARISING FROM OR RELATED TO THE SERVICE SHALL NOT EXCEED THE GREATER OF (A) THE AMOUNTS YOU PAID TO US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM, OR (B) TEN DOLLARS ($10.00).

You acknowledge that the Service provides probabilistic estimates and informational tools only. The Service does not guarantee any hunting outcome, draw result, or application strategy. All application decisions are made at your own risk and discretion.

14. Indemnification

You agree to indemnify, defend, and hold harmless TagMath and its officers, directors, employees, and agents from any claims, liabilities, damages, losses, and expenses (including reasonable attorneys' fees) arising from your use of the Service or violation of these Terms.

15. Dispute Resolution and Arbitration

Any dispute arising from or relating to these Terms or the Service shall be resolved through binding arbitration administered by the American Arbitration Association (“AAA”) under its Consumer Arbitration Rules. Arbitration shall take place in Larimer County, Colorado.

CLASS ACTION WAIVER: YOU AND TAGMATH AGREE THAT ANY PROCEEDINGS TO RESOLVE DISPUTES WILL BE CONDUCTED ONLY ON AN INDIVIDUAL BASIS AND NOT IN A CLASS, CONSOLIDATED, OR REPRESENTATIVE ACTION. If for any reason a claim proceeds in court rather than arbitration, YOU AND TAGMATH EACH WAIVE ANY RIGHT TO A JURY TRIAL.

Small Claims Exception: Either party may bring an individual action in small claims court in Larimer County, Colorado, provided the claim falls within that court's jurisdictional limits.

Opt-Out: You may opt out of this arbitration provision by sending written notice to admin@tagmath.com within 30 days of first creating your account. If you opt out, disputes will be resolved in the state or federal courts of Larimer County, Colorado.

16. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Colorado, without regard to conflict of law principles. Any legal action not subject to arbitration shall be brought exclusively in the state or federal courts located in Larimer County, Colorado.

17. Changes to Terms

We may update these Terms from time to time. We will notify you of material changes by email or prominent notice on the Service at least 30 days before changes take effect. Your continued use of the Service after the effective date constitutes acceptance of the updated Terms.

18. Severability

If any provision of these Terms is held invalid or unenforceable, that provision shall be modified to the minimum extent necessary to make it enforceable, and the remaining provisions shall continue in full force and effect.

19. Entire Agreement

These Terms, together with the Privacy Policy, constitute the entire agreement between you and TagMath regarding the Service and supersede all prior agreements and understandings.

20. Force Majeure

TagMath shall not be liable for any failure or delay in performing its obligations where such failure or delay results from circumstances beyond our reasonable control, including but not limited to natural disasters, acts of government, internet outages, or third-party service failures.
